THE ARBITRATION PANEL DISMISSES THE REQUEST OF MEDIATION SUBMITTED BY ACE/ETNZ ON REINSTATEMENT OF COURSES B AND C.

Following the submission by the Defender/ACE to the Arbitration Panel seeking mediation in relation to the decision ACAP/12, which ruled on the exclusion of courses B and C from the 36th America’s Cup presented by PRADA, the Panel has ruled that the case cannot be mediated and the Application has failed. The Panel found that whilst a mediation could have been a way for the Competitors to agree a solution it can be envisaged only if all Parties agree which was not the case.
